A Missouri judge has ordered a new trial in the case of a man charged with involuntary manslaughter after the portable climbing wall he operated malfunctioned and fatally injured a woman lowering from the wall. Earlier this summer, a jury failed to reach a verdict in the trial of Marcus Floyd, and a mistrial was declared. The new trial was set for Aug. 24. Floyd’s portable wall was set up last summer at a minor-league baseball game. The victim, Christine Ewing, 22, died after the steel cable attached to her harness snapped and she fell 20 feet to the pavement. Investigators found rusted spots on the cable that had been covered up with tape. Floyd has agreed to pay $700,000 to settle a civil suit brought by Ewing’s parents.
